What personal data we collect
When you submit a contact form on this website, we collect the personal data you voluntarily provide. This may include your full name, email address, telephone number, country of residence, property location, estimated property value, investment goals, documents you choose to attach, and any additional information you choose to share. We do not use advertising cookies. If you accept statistics cookies, we also collect website usage data in a pseudonymised form, described in the cookies section. Standard server logs may record technical data including IP addresses and browser information for security and website maintenance purposes only.
Legal basis for processing
The legal basis for processing the personal data you submit through our contact forms is your consent, given at the moment of submission, in accordance with Article 6(1)(a) of the General Data Protection Regulation (GDPR). You may withdraw your consent at any time by contacting us at Ines.osantos@remax.pt. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal. Where processing is necessary for the performance of a contract or pre-contractual steps at your request, we rely on Article 6(1)(b) of the GDPR as the legal basis.
Purpose of processing
Your personal data is collected and processed for the following purposes: to respond to your enquiry and provide the real estate consultancy services you have requested; to assess your property or investment situation and prepare a relevant proposal; to manage and conduct real estate mediation transactions in which you are involved; and to fulfil legal and regulatory obligations under Portuguese and European law. Your data will not be used for automated decision-making or profiling, and will not be used for direct marketing without your explicit prior consent.
Data sharing and recipients
Your personal data may be shared with the following recipients in the context of providing real estate mediation services: João Bordalo - Mediação Imobiliária, Lda, AMI 6275, as the licensed real estate mediation entity through which services are provided; the RE/MAX Collection Valor network and RE/MAX Portugal, in accordance with their own privacy framework available at remax.pt; legal professionals, notaries, solicitors, and other parties directly involved in a transaction in which you participate, and only to the extent necessary for that transaction; public authorities or regulatory bodies where required by law. Your personal data is never sold to third parties and is never shared for marketing purposes without your explicit consent.
International transfers
Your personal data is stored and processed within the European Union. We do not transfer your personal data to countries outside the European Economic Area. If this changes in the future, we will notify you and ensure adequate safeguards are in place in accordance with Chapter V of the GDPR.
Data retention
We retain your personal data for as long as necessary to fulfil the purposes described in this policy, including for as long as required to manage your enquiry and any resulting transaction. Where a transaction is completed, we retain data for the legally required period under Portuguese tax and commercial law, which is generally ten years from the completion of the transaction. If no transaction results from your enquiry, data is retained for a maximum of two years from the date of your initial contact. You may request deletion of your data at any time as set out in Section 9.
Cookies and statistics
This website does not use advertising cookies or third-party analytics tools. We use two kinds of storage on your device. The first is strictly necessary and needs no consent: it keeps your cookie choice (ir_cookie_consent_v1), the language you chose, the progress of forms you are filling in and, in the private areas, the sign-in session. The second is statistics cookies, which are switched on only if you accept them in the notice shown on your first visit. With your permission we record the pages you visit and the order in which you visit them, the time you spend on each page, how far you scroll, the contact links and buttons you click, when you start and submit forms, use of the simulator, your country (taken from the network address, which is not stored), device type, browser, operating system, screen width, language and where the visit came from (for example the website you came from or the campaign). For this we store on your device a random visitor identifier (ir_vid, valid for 13 months), a session identifier (ir_sid, deleted when you close the tab) and supporting session data. This data does not include your name, email or telephone number, is not linked to any enquiry you submit, is not shared with third parties for advertising and is handled only by us, with a hosting provider in the European Union, to understand how the website is used and to improve it. Statistics data is deleted automatically after 13 months. The legal basis is your consent under Article 6(1)(a) of the GDPR and Article 5 of Portuguese Law 41/2004. You can change or withdraw consent at any time through the Cookie settings link in the footer of any page, which stops collection immediately and deletes the identifiers stored on your device. You can also manage or delete your device storage through your browser settings.
Your rights under the GDPR
As a data subject under the General Data Protection Regulation and applicable Portuguese law, you have the following rights: the right to access the personal data we hold about you; the right to rectification of inaccurate or incomplete data; the right to erasure of your personal data, subject to legal retention obligations; the right to restriction of processing in certain circumstances; the right to data portability where processing is based on consent or contract; the right to object to processing based on legitimate interests; and the right to withdraw consent at any time without affecting the lawfulness of prior processing. To exercise any of these rights, contact us at Ines.osantos@remax.pt. We will respond within 30 days of receiving your request. If you are not satisfied with our response, you have the right to lodge a complaint with the Comissão Nacional de Proteção de Dados (CNPD), the Portuguese supervisory authority for data protection, at www.cnpd.pt, Rua de São Bento, 148, 3, 1200-821 Lisboa.
